The Bureau hereby gives update on the investigations relating to corruption allegations
relating to Zuneth Sattar as follows.
1. Following the judgment of Justice Redson Kapindu on 30th May,
2022 dismissing the judicial review proceedings by Hon. Kezzie
Msukwa and Ashok Nair, the Bureau proceeded to resubmit the
application for consent to prosecute the two on 3rd June, 2022.
On 13th June, 2022 the Bureau cautioned Hon. Msukwa and
was planning to take him to court to be charged when the
Bureau was served with an exparte order of stay of criminal
proceedings pending appeal granted by the Supreme Court.
The interpartes hearing took place on 26th June, 2022 and the
Bureau challenged the stay order. The matter is now awaiting
judgment by Justice Kapanda.
2. Ashok Nair also applied for a stay of the enforcement of the
judgment of Justice Redson Kapindu pending appeal. In his
ruling of 17th June, 2022 Justice Kapindu stayed the
enforcement of his judgement. In his ruling he stated that his
order of stay is limited in that it shall subsist at the least, until
the determination by the Supreme Court of Appeal of Hon.
Msukwa’s interpartes application for stay of enforcement of
judgement pending appeal.
3. Criminal proceedings against Hon. Kezzie Msukwa and Ashok
Nair are awaiting determination of the Supreme Court of
Appeal.
4. On 24th June, 2022, the Bureau arrested the former Inspector
General of Police, Dr. George Kainja and legal officer of Malawi
Police, Mwabi Kaluba. The Bureau has since applied for consent
from the Director of Public Prosecutions to prosecute the two
and is currently awaiting such consent to proceed with the
prosecution.
5. Noting the need for more resources to conduct its operations,
the Bureau reached out to Government for more funds. The
Ministry of Finance has informed the Bureau that it will commit
extra K400 Million Kwacha to the Bureau to be provided over
the remaining 8 months of the financial year 2022/23 . This
money will assist in the investigations relating to Zuneth Sattar
corruption allegations and other high-profile cases currently
under investigations by the Bureau. The money will also assist
in hiring of private lawyers for the Bureau to assist in
prosecution of the cases.
6. The Bureau shares the general public sentiments to see to it
that corruption allegations relating to Zuneth Sattar and other
public officers in Malawi and other equally high-profile cases it
is handling are dealt with efficiently. The Bureau undertakes to
do all it can to ensure that Malawians and Malawi get
substantive justice out of all the cases it is handling.
The Bureau wishes to appeal to all Malawians to join in the fight against corruption.
