RULING ON APPEAL AGAINST FORFEITURE OF PAUL MPHWIYO’S AREA 43 BONDED PROPERTY

The Malawi Supreme Court of Appeal comprised of 9 judges led By the Chief Justice Hon. Rizine Mzikamanda JA, on 5th December 2024 dismissed an appeal by Thandizo Verna Mphwiyo. Thandizo Mphwiyo was challenging the forfeiture order which was made by the High Court of Malawi Judge, Justice Ruth Chinangwa on a house in area 43, which was bonded for Paul Mphwiyo’s bail in 2014. The order was made on application by the state to revoke his bail because he had absconded.

In its ruling, the Supreme Court upheld the decision by the High Court saying that the order was properly made under the law.

This means that the house which is valued at MK690 million is a property of the Malawi Government.

Mr. Paul Mphwiyo was answering corruption charges in Court related to cash gate scandal. The case awaits judgment.
