On the 2 August 2022, the Anti-Corruption Bureau received a complaint that Police Officer Osward Mtambo, Head of the Criminal Investigations Department (CID) at Rumphi Police Station, demanded an advantage in form of money amounting to MK 40,000 from a suspect in order not to rearrest the said suspect after he was put on bail.
The Bureau conducted investigations which established that Officer Mtambo, who is the Inspector of Police, in or around August, 2022 demanded and received money amounting to MK40,000 as an inducement in order not to rearrest a suspect that was put on bail in a civil case.
On the 28 September, 2022 the Bureau arrested Police Officer Mtambo. He was
interviewed and recorded a caution statement.
Mtambo has been charged with soliciting and receiving an advantage contrary to
Section 24 (1) of the Corrupt Practices Act and abuse of Office contrary to Section
25B (1) of the Corrupt Practices Act.
He was taken to Court on the same day for plea taking. He pleaded not guilty and
applied for Bail. Bail ruling was held on 29th September 2022.
He was released on bail after satisfying the following conditions:
i. That the suspect be reporting to ACB Mzuzu once in a month;
ii. He was bonded at K100,000 cash
iii. Produced one surety bonded at K100,000 not cash
iii. He should refrain from interfering by way of communicating, threatening and/or harassing witnesses
iv. He should surrender travel documents if any to court
